This Privacy Policy applies to all information that the Program Organizer and/or the Application Owner may receive about the Program Participant (Application User) during participation in the Program and when using the Application.

 

1. TERMS:

"Program" is a program that represents a relationship in which a Participant who purchases goods/works/services from Partners using a Participant's Card acquires the right to receive Bonuses or other preferences in accordance with these Rules. The program is open-ended and may be terminated by the Organizer at any time.

"Participant" is an individual over the age of 18 who has agreed to these Rules by registering in the Program.

"Organizer" is a legal entity with exclusive rights to manage and develop the Program, which is a party to all transactions related to the accrual and write–off of Bonuses and other preferences under the Program. The details and contact details of the Organizer are contained in the table at the end of the text of this Policy.

"Partners" are organizations/individual entrepreneurs who have concluded Program agreements with the Organizer and sell goods/works/services for which Participants receive Bonuses or other preferences. 

"Application" is a mobile application for users' smartphones that allows them to become a Participant in the Program by registering in the Program, create, store and use Participant Cards in accordance with the functionality of the application, attach a Participant's bank card to pay for goods/ works/services under the Program, create and use Electronic Gift Cards and use other Application resources.

"Participant Card" is an electronic card used to identify a Participant in the Program when purchasing goods/works/services from Partners, which is assigned to the Participant upon registration in the Application, or a plastic card issued by an employee of the Program Partner (such card is the property of the Organizer). There is no charge for issuing the Card from the Participant.

"Bonuses" are accounting units credited by the Organizer (agent) on behalf of the Participant (principal) to the Participant's Account in the Program.

"Participant's Account" is created by the Organizer when registering a Participant in the Program, which is a set of information about the Participant, Bonuses and other preferences provided to him, spent and cancelled Bonuses, by entering the relevant data by the Organizer. 

The "Application Owner" is the person who owns the exclusive rights to the Application software, the rights to modify, develop, and manage the Application. The details and contact details of the Application Owner are contained in the table at the end of the text of this Policy.

"Application User" is an individual who has reached the age of 18 and uses the Application's services.

A "Web Application" is an analog of a mobile Application, a resource located at the address indicated in the table at the end of this document, which allows the Participant to access the Participant's Account and purchase EPA using a web browser.

 

 

2. GENERAL PROVISIONS

2.1. When registering a Participant in the Program, during the Participant's participation in the Program, and during the period of the Participant's (User's) use of the Application, the Organizer and the Owner consider and protect as "confidential" all information received from the Participant (User), in accordance with the current legislation of the Russian Federation.

2.2. Registration in the Program and use of the Application, in accordance with the Rules of Participation in the Program, means voluntary and informed consent in full with this Privacy Policy. In case of disagreement with this Privacy Policy, the Participant must terminate his Participation in the Program (the User must stop using the Application).

2.3. The Organizer and the Owner of the Application do not verify the accuracy of the information provided by the Participant (User). The Participant (User) is responsible for the accuracy of the data.

3. PROCESSING AND PROTECTION OF PERSONAL DATA OF THE PARTICIPANT (USER)

3.1. The collection and processing of personal data of the Participant (User) is carried out in accordance with the current legislation of the Russian Federation in order to organize the Participant's participation in the Program, the Participant's use of the Application and the improvement of the Application Owner.

3.2. The Participant's (User's) personal data, in addition to those specified during registration in the Program (last name, first name, date of birth, email address, mobile phone), also includes other information related to the Participant's (User's) participation in the Program, including: information about the device (smartphone) The User, the Participant's Card number, the Participant's Account and transactions on the Participant's Card, as well as additional information that the Participant (User) reported about himself in the Application menu after installation, for example: gender, postal address, happy dates, marketing data and surveys, location.

3.3. The Organizer and the Owner process the Participant's (User's) personal data using an automated information system by: collecting, recording, systematizing, accumulating, storing, clarifying (updating, changing), extracting, using, transferring (distributing, providing, accessing), depersonalizing, blocking, deleting, destroying, exclusively in in order to organize the Participant's participation in the Program and to provide the Participant (User) with access to use the Application's functionality, including for the purposes of:

- providing an opportunity to restore the Participant's Card in case of its loss or damage;

- providing an opportunity to receive a detailed transaction report on the Participant's Card, indicating the location, time and type of transaction;

- providing an opportunity to block the Participant's Card in order to avoid its unauthorized use;

- analysis of sales, basic preferences and needs of Participants (Users);

- timely response to requests and complaints from Participants (Users);

- receiving personalized (targeted) advertising by the Participant (User);

- verification, research and analysis of data, allowing to maintain and improve the functionality and sections of the Application.

3.4. The Organizer and the Owner take all necessary measures to protect the Participant's (User's) personal data from unauthorized access, modification, disclosure or destruction, and use secure data transmission channels.

3.5. The Organizer and the Owner provide access to the Participant's (User's) personal data only to those employees, affiliated persons, contractors and agents who need this information to ensure the Participant's participation in the Program and the functioning of the Application.

Disclosure of the information provided by the Participant (User) may be made only in accordance with the current legislation of the Russian Federation at the request of a court, law enforcement agencies, as well as in other cases provided for by the legislation of the Russian Federation.

3.6. By performing the entire sequential list of actions for registration in the Program in accordance with the Rules of Participation in the Program, the Participant (User) expresses his informed and voluntary consent to the storage, processing and use of personal data provided by him to the Organizer and the Owner without limitation of the validity period.

3.7. The condition for termination of processing by the Organizer and the Owner of the Participant's (User's) personal data is:

• written request of the Participant (User) - the subject of personal data;

• The court's demand;

• liquidation of the Organizer and/or Owner;

• termination of the Program by the Organizer;

• Deletion by the App Owner.

3.8. Upon achievement of the processing objectives or in case of loss of the need to achieve these objectives, the processed personal data of the Participants (Users) are subject to destruction or depersonalization, unless otherwise provided by the Law of the Republic of Armenia "On Personal Data Protection", adopted on May 18, 2015 (No. ZR-49)

. Information about the device (smartphone) The user and their location.

3.9.1. The Organizer and the Owner of the Application, as well as their employees, contractors and agents, have the right to collect, store and process technical information about the device (smartphone) for the proper functioning of the Application The user, which includes:

- data about the User's device (smartphone) model (manufacturer, model, operating system version, device identifier and other technical parameters and identifiers, including IMEI);

- statistical information about App launches and activities in it;

- other technical data necessary to improve the functionality and performance of the Application.

3.9.2. Location data of the User's device (smartphone):

- Before or after registering in the Application on the "Partners" or "Addresses on the map" page, the Owner will ask the User to allow the Application to access information about the location of the User's device (smartphone) in active mode in order to display the Program Partners closest to the User, in whose outlets you can use the Participant's Card.

If the User has selected "Prohibit", the Owner will not be able to display the Program Partners closest to the User.

- After registration and allowing the Application to access information about the location of the User's device (smartphone) in active mode, on the page: "Partners", or "Addresses on the map" or "Personal Account/Settings", the Owner will ask the User to allow the Application to send geo-notifications about nearby outlets of the Program's Partners, where you can use the Participant's Card.

If the User has given their consent, the Owner will ask the User to allow the Application to access information about the location of the User's device (smartphone) in the background.

In order for the Owner to send geo-notifications, even when the Application is turned off, it is required that the User select "Allow in any mode" in the smartphone settings (the User's device (smartphone) location data will be processed by the Application in the background).

If the User has selected "Allow only when using the App", the User will not be able to receive geo-notifications when not using the App (in the background).

To determine the location of the User's device (smartphone), factors are taken into account: information about objects around the User, GPS data, and the MAC address. If the User does not agree with the provision of such data, this function can always be disabled or changed in the settings of the User's device (smartphone).

 

4. ADDITIONAL CONDITIONS

4.1. The Organizer and the Owner have the right to make changes to this Privacy Policy at any time without notifying the User.

4.2. The new version of this Privacy Policy comes into force from the moment it is posted, unless otherwise provided by the new version. By continuing to participate in the Program and using the Application, the Participant (User) confirms his agreement with the current terms. In case of disagreement, the Participant (User) must stop participating in the Program and using the Application.

4.3. The Participant (User) undertakes to independently monitor changes to the terms of this document. The current version of the Privacy Policy is available in the Application.
